User Agreement

By using one or more of the FamilyArc Services, you agree to be bound by this User Agreement, as well as the Privacy Policy and any other policies posted by FamilyArc.
It is your responsibility to review this User Agreement periodically. If you find the terms unacceptable, please stop using this Portal and cancel your account. We may revise this User Agreement at any time. If you have any questions, please contact us at support@FamilyArc.com.
1. Certain Definitions.
- "Advisor" means (i) an employee of, or an independent contractor providing services to, an advisor or an Affiliate which purchased an Advisor FamilyArc Subscription on his or her behalf; and who is authorized to access and use the Portal, or (ii) a professional services provider who purchases a FamilyArc Subscription directly from FamilyArc.
- "Affiliate" means an entity that controls, is controlled by, or is under common control with an Advisor.
- "Client User" means an individual who accepts an Advisor’s invitation to the Portal by registering for a FamilyArc Subscription.
- "Documentation" means all documentation made available to User by FamilyArc for use with or in support of the Portal, including all revisions and updates thereof.
- "FamilyArc Services" means the Portal, the User Account, the FamilyArc Subscription, and any other products or services FamilyArc provides or makes available to Users through the Portal.
- "Licensed Materials" means the FamilyArc Subscription, and any Marketplace Products that have been purchased by or on behalf of the User.
- "Marketplace Products" means products and services available for purchase from the marketplace within the Portal, other than the FamilyArc Subscription.
- "User" means any Advisor or Client User.
- "User Account" refers to a User’s unique, password-protected account on the Portal.
- "User Data" means all data entered into the Portal by or on behalf of a User.
2. Changes to User Agreement.
Any changes to the User Agreement will be posted on this page. You are responsible for periodically visiting our Website and Portal to review this User Agreement for any changes, as they are binding on you.
3. Obtaining Access to FamilyArc Services.
An individual may obtain access to the FamilyArc Services in one of the following ways:
- An Advisor may be granted a FamilyArc Subscription or may purchase an individual FamilyArc Subscription.
- An individual who is not an Advisor may be granted a FamilyArc Subscription by an Advisor or a Client User.
Once a User has established a User Account, they are considered to have accepted the FamilyArc Subscription.
4. Terms For All Users.
1. License Grant.
FamilyArc grants User a limited, revocable, non-exclusive license to use and access the Licensed Materials.
2. No Provision of Investment, Legal or Financial Advice.
FamilyArc is not providing, and does not purport to provide, any investment, legal or financial advice whatsoever.
3. Limitation of Liability.
In no event shall FamilyArc or any of its third-party providers be liable for any indirect damages arising from this User Agreement.
4. Term of FamilyArc Subscription.
The FamilyArc Subscription shall continue indefinitely unless terminated pursuant to this User Agreement.
5. Suspension and Termination.
- FamilyArc may suspend access to services if it reasonably concludes that the User is engaging in any prohibited activity.
- Termination for cause may occur with five (5) days’ written notice due to a material breach of this User Agreement.
6. Logon Credentials.
Users shall maintain the confidentiality and security of logon credentials.
7. Ownership and Use of Data.
The party that provided data to FamilyArc shall be the owner of such data.
8. Payment.
All purchases of FamilyArc Services shall be paid at the time of purchase.
9. Copyright Policy.
Users may report claims of copyright infringement.
5. Advisor Services.
Advisors with an active FamilyArc Subscription can view and maintain information within the Portal on behalf of clients. Advisors can invite clients to register for a complimentary FamilyArc Subscription. The Advisor may also be eligible for referral fees.
Email Communications and Notices.
Advisors shall confirm email addresses for communication purposes related to this User Agreement.
Restrictions.
Advisors shall not make representations regarding FamilyArc services other than those in the marketing materials.
